General Terms and Conditions of Sale

 

ARTICLE 1 - SCOPE

The General Terms and Conditions of Sale set out below (hereinafter referred to as the "General Terms"), govern the contractual relationship between any user of the site (hereinafter referred to as the "User") and the trading name STABUSTRAP belonging to CGP ONLINE a company with capital of 60,000 euros, whose registered office is at 48 route de Bourges 18110 Saint-Georges-sur-Moulon FRANCE and which is registered with the Bourges RCS (companies register) under the number B 823 146 295.

These General Terms and Conditions of Sale are the only applicable terms and replace all other terms, save for prior, express, written exceptions. Each purchase on the Site is governed by the General Terms in force as at the date of the order. By placing your order, you confirm that you have read the General Terms and accept them without reservation. By accessing the Site, you promise to comply with these terms.

 

ARTICLE 2 - AVAILABILITY OF SITE

The Site is usually accessible 24 hours a day, 7 days a week, for all Users. CGP ONLINE will not, however, be held liable for any interruption of the Site and its services, whether deliberate or not.

In order to use the Site, you must be at least 18 years of age, possessed of the legal capacity to contract, and you must use the site in accordance with these General Terms. The User guarantees that the information he or she provides when browsing the Site is truthful and accurate.

CGP ONLINE reserves the right to cancel or refuse any order from a client with whom there is an outstanding dispute relating to payment of a previous order.

The Site is available in French.

CGP ONLINE reserves the right, without notice or indemnity, to temporarily or permanently suspend the Site or access to one or more services to carry out updates, amendments or alterations of operating methods, servers or accessible hours.  This list should not be considered exhaustive.

 

ARTICLE 3 - INTELLECTUAL PROPERTY

The Site, and the entirety of its contents, are protected by copyright, trademarks, industrial designs, patents and/or any other intellectual property right. The aforementioned contents of the Site include: photographs, images, drawings, illustrations, text, videos, logos, screensavers, wallpapers, brands, industrial designs and software but this list is not exhaustive.  This content belongs to CGP ONLINE or is used with the permission of the rights holders.

In respect of this content, any reproduction, representation, use, adaptation, modification, incorporation, translation or commercialisation, whether of the whole or part, through any means and in any format whatsoever (paper, digital...) is forbidden, without the prior written permission of CGP ONLINE, save for the exceptions set out in article L122.5 of the French Intellectual Property Code.  Any breach of this protection will constitute a criminal offence of infringement of copyright and/or industrial design and/or trade mark.

 

ARTICLE 4 - USE OF THE SITE

 

1) Price

Prices are shown inclusive of all taxes, but exclusive of shipping costs.

For shipping to countries other than mainland France, you are considered the importer of the products in question. In respect of any products shipped outside of the European Union or DOM-TOM French overseas territories, customs duties or other local taxes, or state import duties or taxes, may be payable.

Such duties and sums are not the responsibility of CGP ONLINE. These costs are borne by you and it is your sole responsibility to deal with both declarations and payments to the competent authorities and organisations in your country. You are advised to approach your local authorities for further information on these points.

CGP ONLINE reserves the right to modify its prices at any moment without notice. The products will be invoiced at the prices in force at the moment that the order is confirmed, subject to availability.

The products remain the property of CGP ONLINE until full payment of the indicated price has been made.

 

2) Ordering

To place an order, you will need to follow these steps as a minimum:

View the page showing a product. On this screen you choose the material, the format and then the visual options. A summary of the product chosen is shown in order to confirm or cancel the selection. You must then click "Add to basket" to add this item to your basket.

    Summary and payment selection screen. This screen allows you to choose your method of payment and check the various details of your order (items, quantity, delivery options, total price). You must ensure that all of these details correspond to your wishes. Using the links on this screen you may amend your order.

 By confirming the order and continuing to the payment page the User accepts these General Terms and Conditions of Sale and without reservation. The terms may be read and printed via the link entitled "General Terms and Conditions of Sale"

    Pay for your order using the selected payment method

    The contract is entered into once the bank confirms transfer of the payment.

    The Site will send you an order confirmation by e-mail shortly afterwards.

 

3) Payment methods

Several payment methods are available to pay for your order on the Site:

    Carte Bleue, Virtual Carte Bleue, Visa, Mastercard.

4) Payment security

For payments using credit or debit card, the transaction is carried out by XXXXX, the payment system of Crédit Agricole, on the website of Crédit Agricole.

The bank details of the User are encrypted using SSL (Secure Socket Layer) technology. They are not openly communicated over the internet and cannot be intercepted.

Your bank details (card number, expiry date...) are not shared with CGP ONLINE.

 

5) Proof

The data recorded by the Site constitute proof of all transactions between the Site and its customers.

The data recorded by the payment system xxxxx of xxxxxx constitute proof of the financial transactions.

 

6) Availability

The products offered on the site are valid subject to availability of raw materials from the suppliers to CGP ONLINE. In the event that a product is unavailable or that CGP ONLINE is unable to honour the order after it has been accepted, CGP ONLINE will notify the customer in question as soon as possible. The customer may then request that their order be cancelled or changed by writing to Customer Service, the address of which is shown on the first page of this document

In the event that a product is permanently unavailable and if CGP ONLINE cannot provide a product of equivalent quality and price, the customer's order shall be automatically cancelled and refunded.

 

7) Delivery

CGP ONLINE delivers to mainland France and the following countries: Belgium, Czech Republic, Denmark, Germany, Greece, Hungary, Ireland, Italy, Luxembourg, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, United Kingdom.

Delivery to other countries: on request

Delivery will be to the delivery address that you confirmed when placing the order as being the "delivery address", which may be different from the "billing address". The User agrees to accept delivery of the products ordered.

It is often impossible to change the delivery address once the order has been placed, for logistical reasons. However, you may contact us, if you wish to change the delivery address, and we will assess whether this is possible in the circumstances.

 

Delivery methods and times

The available delivery methods depend on the quantity of the articles being ordered and the country of delivery. CGP ONLINE reserves the right to select the carrier.

The delivery date depends on stock levels, despatch date of the order and the delivery timescales particular to the delivery method. Delivery times shown on the Site are average times and relate to processing and delivery times for products being shipped within mainland France.

CGP ONLINE will make every effort to deliver your order in the timescales shown in the Delivery Email. For Delivery to a delivery point, an email or SMS will be sent to the User upon arrival of your package at your selected delivery point. On or after the delivery date, you may retrieve your package by showing a form of identification.

While we make every effort to deliver your products in compliance with the timescales set out above, delivery dates are no purely estimates, are not guaranteed, and we accept no liability in this respect.

Delivery costs

Delivery costs vary depending up on the country and method of delivery as well as the number and format of the works you have ordered. Delivery costs are calculated and shown prior to final order confirmation.

Receipt of delivery  

Upon receipt of your order, it is your responsibility to open the package to check the contents.  If you are not going to receive the package in person, ask the person who will be receiving it on your behalf to carry out this check.

If there is a problem, please hand your package back to the delivery person (postal service or private transporter), stating the problem, and contact our customer service team on the same day. 

In the event of delivery by a private transporter, they are not required to deliver to the inside of the building and may hand you the package at the entrance to the designated address.

Once the goods have been received, the recipient must notify the transporter by legal notice or registered post of their complaint, giving reasons, within three days (not counting public holidays) following receipt of the goods, failing which any action against the transporter for damage or partial loss will be impossible. (article L 133.3 of the French Commercial Code).

 

8) Right to cancel

For all purchases on the Site, you have a maximum of 15 calendar days after receipt of the product to notify us of your request to return the same.

In order to do so, please contact our customer service team who will inform you of the returns address, following which you will have 14 days to return your order to us.

No cash-on-delivery exchange will be allowed, for any reason whatsoever.

Items returned incomplete, broken, damaged or dirtied by the customer, or without their original packaging, will not be accepted. Returns are at your own expense.

CGP ONLINE will refund the price of the returned items as well as the initial delivery costs (the return costs being at your expense) within 14 days from receipt of the items or of proof of shipping of the items. This refund will be made by a credit to the bank account used to pay for the items, by bank transfer or gift voucher, depending on the method of payment used when ordering.

Note that the right to cancel does not apply to custom-made or personalised goods.

9) Right of return

In the event that the products received do not match those ordered, you have the right to return them. Please contact our customer service team who will inform you of the returns address and procedure.

CGP ONLINE will exchange the damaged article, subject to stock availability. In the event that an item is no longer available, CGP ONLINE will ask you to choose another item of the same value.

Where an item is returned in pursuance of the right of return, and only in such circumstances, CGP ONLINE will bear the costs of return delivery and delivery of the new item.

ARTICLE 5 - FORCE MAJEURE

In accordance with article 1148 of the French Civil Code, CGP ONLINE may not be held liable or be considered to be negligent in the processing of your order, if a delay or a failure to fulfil the order results from force majeure.

ARTICLE 6 - DATA PROTECTION

The automatic processing of personal information has been declared to the National Commission of Information Technology and Freedoms (CNIL) under the number 1280165.

Depending on your chosen options when creating or amending your account, you may receive offers from our company and from our partners. If you no longer wish to receive such communications, you can change the options in your Customer Account on the Site or by writing to us at the address below.

You can consult or amend your personal data in your customer account on the website.

ARTICLE 7 - LIABILITY AND GUARANTEES

CGP ONLINE shall endeavour to the best of its abilities to ensure that information shared on the site is accurate and up to date, and reserves the right to correct such content at any moment and without notice.

This site may contain links to other sites. CGP ONLINE may not be held liable for problems accessing those sites, or the content thereof.

CGP ONLINE may not be held liable for damages resulting from using, or the fact of being unable to use, the Site.

CGP ONLINE shall under no circumstances be liable for malfunctions attributable to software, whether or not this is part of the website or provided therewith.

CGP ONLINE promises to comply with all statutory guarantees to which you may be entitled. In the event of faulty merchandise, you will be afforded the benefit of statutory guarantees as set out in current legislation. All products presented on the site are compliant with French legal standards.  We may not be held liable in the event that they contravene legislation within the destination country. As a result, we encourage you to seek information about the legislation in force in the destination country.

The guarantees set out in article 5 of this document apply only if the products are purchased directly through the Website.

You are entitled to the following legal guarantees:

The statutory guarantee of conformity (articles L. 217-4 and subsequent articles in the French Consumer Code),

If your products do not conform (for example if they do not match the description given on the site or set out in your order), you have two years from delivery of the goods to contact our Customer Service team by email and return the unsatisfactory goods. We will then send you replacement products, provided they are available.

If we are unable to replace the unsatisfactory products within thirty (30) days, you can:

- request a full refund of the unsatisfactory products or

 

- keep the unsatisfactory products and ask us for a partial discount of the price, to be determined on a case-by-case basis.

 

You are exempt from the requirement to show proof of the existence of the fault in the conformity of the product in the 24 months following the delivery of the goods.

This statutory guarantee of conformity applies independent of any commercial guarantee which may have been entered into.

The statutory guarantee against hidden defects (articles 1641 and subsequent articles in the French Civil Code). If you are able to prove the hidden defect of a product, we are legally obliged to compensate you for the consequences of such a hidden defect (articles 1641 and subsequent articles in the French Civil Code). You may then choose between cancellation of the sale or a price reduction (in accordance with article 1644 of the French Civil Code).

 

ARTICLE 8 - APPLICABLE LAW

These terms and conditions are governed by French law. They are available in the same language in which the Site is available. In the event that a dispute arises from the contractual relationship under advisement, the User and CGP ONLINE both agree to seek an amicable solution before embarking upon legal action. In the event of a dispute, the French courts shall have sole jurisdiction.
